TERMS AND CONDITIONS OF USE
These Terms and Conditions of use (hereinafter also referred to as the “Agreement”) set out
the conditions under which Naturforma S.R.L., with its registered office in Bodoc, No. 49, Tax
Identification Number: 44520048, registered with the Trade Register Office attached to the
Covasna Tribunal under no. J14/261/2021, e-mail: office@naturforma.com (hereinafter
“Naturforma SRL”), makes its software and services available through the website
https://naturforma.com as well as through the Naturforma application for mobile devices
(collectively referred to hereinafter as the “Service”) to you, as a user of the Service
(hereinafter referred to as “You” or the “User”).
The Naturforma application is created by Naturforma SRL and all property rights belong to it.
REGISTRATION. ACCOUNT CREATION
By creating an account as a User of the Service (by providing your e-mail address and setting
a password), which is necessary in order to use the Service, including the Naturforma
Application, as well as by using the Service in any other way, you express your consent to
enter into legal relations with Naturforma SRL, governed by the provisions of this Agreement,
in its latest updated version existing on the date of the creation of the Account. To this end,
you undertake to fully comply with the provisions of the Agreement and expressly and
unequivocally accept both the terms and conditions of use (the Agreement) and the
Naturforma Personal Data Processing Policy
(https://www.naturforma.com/politica-de-confidentialitate/), which forms an integral part of
this Agreement.
By creating and using the account, the User assumes responsibility for
maintaining the confidentiality of the account data (username and password), for
managing access to the account, and is responsible for the activity carried out
through their account.
By registering as a User of the Service, you declare on your own responsibility and warrant
that:
• (a) you are over 18 years of age;
• (b) the information provided by you for registration is accurate, current and complete;
• (c) your registration as a User and use of the Service are not prohibited by law.
Should you breach any of the terms and conditions of this Agreement, Naturforma reserves
the right to suspend or permanently discontinue the provision of the Service to you, with or
without notice.
Naturforma reserves the right to modify this Agreement, and any such modifications will take
effect upon updating the Agreement.
PLEASE READ THIS AGREEMENT CAREFULLY AND PERIODICALLY REVIEW ITS TERMS
AND CONDITIONS IN ORDER TO STAY INFORMED OF ANY CHANGES.
DEFINITIONS
The terms used in this Agreement shall have the following meanings:
“Naturforma”, hereinafter also referred to simply as the “Application”, represents a piece of
software, including its graphical user interface, over which Naturforma holds all copyrights,
designed to run on mobile computing equipment of the smartphone type, and which is
distributed by Naturforma SRL, in accordance with its own business policies, through online
stores (App Store, Play Store) and through the website www.naturforma.com (hereinafter
referred to as the “Website”). The Application has two versions – a free version and a paid
version. The free version of the Application does not provide the User with access to all the
features of the Application, while the paid (monetized) version is characterized by the
existence of additional features.
“User” means any natural person over 18 years of age who uses the Service (the software
and services made available by Naturforma through the website https://naturforma.com or
through the Naturforma application for mobile devices).
“Service” means the entirety of services and/or products (e.g. the Naturforma software)
offered by Naturforma for use by the User through the website https://naturforma.com as
well as through the Naturforma application for mobile devices.
“User Content” means any and all information, data, photographs, text, graphics, video and
other materials that a User submits to Naturforma as part of their registration as a User of
the Service or which are posted by the User as a result of using the Service.
“Partner” means any professional and/or legal entity carrying out commercial or other
activities and which has concluded a contract with Naturforma SRL, and which are listed
under this category by Naturforma SRL.
“Naturforma SRL” means the holder of all rights with respect to the Service, including
copyrights and any other intellectual/industrial property rights with respect to the
Service/Naturforma Application, including the Naturforma content and/or the associated
computer programs. Partners and Users will not dispute or challenge, directly or indirectly,
during the contractual relationship and after the termination of the Agreement, any of these
rights or their validity.
MINIMUM TECHNICAL REQUIREMENTS FOR USING THE APPLICATION
The Naturforma application can be downloaded and installed on smartphones with Android
and iOS operating systems from the dedicated stores Play Store – for Android, and App Store
– for iOS.
Operating systems and internet browsers may behave differently depending on factors
related to the way they differ, and Naturforma does not guarantee the full functionality of the
Application. Please note that occasional malfunctions may occur, which Naturforma will try to
remedy as soon as possible. The User will be informed about such situations through the
communication channels available to Naturforma.
Naturforma is not liable for any errors that may occur during the use of the Application due to
malfunctions, errors or non-compliance with the legal provisions governing the use of
services in general, and telecommunications services in particular.
As a customer, you may have access to the Naturforma application through a third-party
organisation such as one of the Partners of Naturforma SRL.
GENERAL DESCRIPTION OF THE APPLICATION. PURPOSE OF THE
APPLICATION
Naturforma is an original application dedicated to the adoption of a healthy lifestyle by
offering a professional, fast and efficient way of creating clean-eating type menus.
NATURFORMA is a tool for correcting certain risk factors associated with an unhealthy diet.
This is because NATURFORMA automatically offers healthy menus built on the principles of
clean eating. These menus are personalised according to the User’s metabolic profile.
NATURFORMA also automatically generates the list of ingredients.
NATURFORMA has global applicability, also given the existence of an English and a Hungarian
version.
The application is for informational purposes only and is not intended to provide
therapeutic solutions or diagnostic assistance. The application is not a medical
device.
The User declares that they have been informed and agrees that the use of the Application
does not in any way and for any reason replace consultation with a specialist physician.
The Application is not to be considered a diagnostic or therapeutic tool. For medical
recommendations, we advise Users to consult a specialist physician.
FEATURES OF THE APPLICATION
Currently, the Naturforma application allows Users to access the following main features:
Body weight modification
A nutritionist within the Application personally calculates the optimal daily calorie and
macronutrient requirements and assigns the corresponding menus according to this
objective, with a view to controlled reduction of the body mass index.
Personalised daily menu assignment
Based on your own metabolic profile, personalised daily menus are assigned, with the calorie
and macronutrient requirements you need each day.
Generation of an ingredient list
After the menus are assigned based on the metabolic profile, the User selects their preferred
ones, adds them to the list, and the list of ingredients is immediately created – in exactly the
required quantities – to prepare the recipes that make up the daily menus. The User can take
this list with them when shopping.
Sending in-app messages
FEES FOR USE OF THE SERVICE. PAYMENT AUTHORISATION
If you purchase any paid Service, either as a one-time purchase or on a subscription basis,
you firmly undertake to pay the fee for it to Naturforma and authorise Google Pay or Apple
Pay to charge the amounts representing the fees from your bank card.
All financial operations and payments made for the purchase are processed by Google Pay or
Apple Pay. The fees and commissions charged for these operations are not borne by the
Users, but by NATURFORMA SRL.
Naturforma does not have access to and does not collect information related to the User’s
financial transactions. The User’s payment information is stored in the systems of Google Pay
or Apple Pay, which are also responsible for the security of the transactions carried out using
the User’s card.
Cash payments are not accepted.
NATURFORMA reserves the right to interrupt the use of any User account or any password,
whether chosen by you or assigned by Naturforma SRL, at any time, in case of breach of this
Agreement or in case of suspected fraud.
RECURRING SUBSCRIPTION
By requesting the Service on a subscription basis, you agree that the subscription chosen by
You shall be renewed periodically.
Naturforma may from time to time offer a free subscription for testing the paid version of the
Application. If you sign up for a free trial subscription, upon expiration of the free trial period
you will start using the paid subscription and authorise the App Store, Play Store to charge
the subscription fee from your bank account, unless you inform Naturforma that you no
longer wish to use the subscription before the end of the free trial period.
ACCESSING THE NATURFORMA APPLICATION
The functioning of the Application is conditional upon the phone having an internet
connection (Wi-Fi or mobile data) and the optimal functioning of the device on which the
Application runs. Naturforma assumes no obligation and will not be liable for the Users’
inability to use the Application as a result of the User’s device not having access to the
Internet or other technical impediments related to the user interface.
The User accesses the Application through the authentication method provided in the
Application, as set out in the dedicated stores Play Store – for Android, and App Store – for
iOS.
The permissions requested are mandatory requirements imposed by the operating systems,
and Naturforma assumes no responsibility for the unauthorised use, incompatible with the
purpose mentioned above, abusive or unlawful use of the data mentioned. The User
expressly declares that they release Naturforma from any such liability by downloading the
Application and giving consent to the access to the data mentioned above.
In order to ensure the security of your data, we recommend that you do not disclose your
registration data to anyone. Likewise, to the extent that you suspect that your registration
data has been disclosed, we recommend that you proceed to change your account password.
Registration as a User implies acceptance of the provisions of the Terms and Conditions
(Agreement) and of the Personal Data Processing Policy of Naturforma SRL.
Following the creation of the account, in order to provide the services offered through the
Application, personal data will be collected, as mentioned in the Personal Data Processing
Policy (https://www.naturforma.com/politica-de-confidentialitate/), such as, but not limited to:
a valid e-mail address and location.
In order for the Application to function optimally, the User must allow it to access certain
functions of the phone, in accordance with the requests received via system messages within
the Application, e.g. enabling notifications, location (GPS), as well as other functions that may
be added during the development of the Application, in accordance with the message
received through it. It is conclusively presumed that the User has expressly given their
consent to the use of the new features of the Application if the User continues to use the
Application after it has been modified by the addition of new functionalities.
With regard to geolocation as a future requirement, please note that if you do not choose for
geolocation to function only when the Application is open, or if you do not manually close it
after the Application has been closed, it will continue to run in the background of your phone,
providing further geolocation data. Likewise, if you decide not to allow access to geolocation,
certain features of the Application will be only limitedly accessible.
PROCESSING OF PERSONAL DATA. INFORMATION ON ACCESS,
COLLECTION, USE AND TRANSMISSION OF USER DATA

which forms an integral part of this document.
LINKS TO THE NATURFORMA APPLICATION
You may refer to the Application via a link, as long as you do so in a fair manner, which does
not damage Naturforma’s reputation and does not take advantage of our reputation for
personal purposes.

INTELLECTUAL PROPERTY RIGHTS. USE OF THE SERVICE
Subject to the terms of this Agreement, Naturforma authorises you to use the Service for
personal, non-commercial purposes. You are not allowed to remove any copyright, trademark
or other proprietary notices that have been placed on the Service.
You agree and warrant that your use of the Service will be in accordance with the license,
permissions and restrictions set out herein, will not infringe the rights of any third party or
any contractual or legal obligations. In addition, you undertake to comply with all applicable
laws and regulations regarding the Service or your use of it and that you will be solely
responsible for any breach of legal obligations in your use of the Service.
We retain the right to implement any modifications to the Service at any time, with or
without notice. You agree that certain actions of Naturforma may affect or prevent you from
accessing the Service at certain times and/or in the same way, temporarily or permanently,
and you agree that Naturforma assumes no liability with respect to such actions or their
results, including but not limited to the deletion or impossibility of making available to you
any content of the Application or Service.
The Application, its components, graphic elements, and content, the content of the website
https://naturforma.com such as, but not limited to, photographs, texts, animations and all
works integrated in the Application and/or websites are protected by copyright and related
rights, as well as by intellectual property rights belonging to Naturforma or third parties who
have authorised Naturforma to use them, unless otherwise specified. The User understands
that they have no rights over them, except for the limited right to install and use the
Application, in accordance with this Agreement.
The name “Naturforma” and the Naturforma logo are trademarks registered by Naturforma
SRL. All rights reserved.
All company names, trademarks whether registered or not, service/trade/product marks,
trade names, logos and emblems are protected by the rules applicable in the field of
intellectual property rights. The User is prohibited from using any text, image, trademark,
logo, compilations (collection, arrangement and assembly of information), data, other
content, software and materials displayed on the Application belonging to NATURFORMA SRL,
its Partners or other third parties, unless they have obtained the prior written consent of the
rights holders.
You may download and use the Application solely for personal, non-commercial purposes, for
which NATURFORMA grants you a non-exclusive and limited license to that effect.
Accordingly, the following are prohibited:
• use of the Application/Service for unlawful purposes;
• selling, exporting, licensing, applying reverse engineering methods to, modifying, copying,
redistributing, uploading, posting, transmitting, distributing or otherwise exploiting the
Service or any part of the Service or Application without the prior written consent of
NATURFORMA SRL;
• creating derivative works, sublicensing, lending, or using the Application, the underlying
software of the Application, or any other components thereof for any other purposes;
• otherwise making the Application available so that a third party may copy it;
• republishing materials uploaded to the Application (including republication on various
online and/or offline websites or platforms);
• publicly displaying any materials uploaded to the Application; reproducing, copying or
exploiting materials uploaded to the Application for commercial purposes.
USER CONTENT
The information you provide to us as part of your registration as a User of the Service and
any data, photographs, text, graphics, videos and other materials that you submit to
Naturforma or post as a result of your use of the Service (“User Content”) remain your
intellectual property. Without prejudice to the foregoing, you agree that Naturforma may
keep copies of all registration information and User Content, which it may use as reasonably
necessary for or as a result of the operation of the Service, as described in the Agreement
and the Personal Data Processing Policy. To this end, you grant Naturforma the exclusive,
territorially unlimited, transferable, perpetual, and irrevocable right to use, adapt, integrate
into other works the materials submitted by you, for any purpose, to publish, distribute,
publicly display and use the User Content in connection with the Service, and in accordance
with the Personal Data Processing Policy of Naturforma SRL.
It is forbidden for the User to post information of a vulgar, threatening or indecent nature, as
well as content that infringes the rights of a third party or contains viruses or other harmful
materials. Texts/Information/images and, in general, any materials posted within the Service
must: (i) not include licentious, immoral or anti-social content; (ii) not in any way prejudice
the trademarks, products or image of Naturforma SRL; (iii) not contain defamatory details,
words or symbols that are offensive in general or directly to people of a particular race,
ethnicity, religion, sexual orientation or socio-economic group; (iv) not contain threats to any
third person, place, business or group, not violate the privacy, the right to private life and/or
other rights of any third person, company or entity, and not otherwise infringe applicable
laws and regulations; (v) be realistic, free from texts, logos or any other materials involving
copyright or any other protected rights that do not belong to the User.
The User agrees to access and use the Application/Service at their own risk. Accordingly,
Naturforma SRL, its affiliates, employees, agents or any other party involved in the design,
development, management and maintenance of the Application/Service cannot be held liable
for any direct or indirect damage, in particular for material damage, loss of data or programs,
financial loss, resulting from access to or use of the Application/Service, or from the inability
to use the Application/Service or any material published in the Application/Service or added
by other users.
Naturforma makes every effort to ensure your access to information that is as accurate as
possible, but we cannot guarantee that the Service/Application is free from errors or that
there will be no errors or omissions in its content. Likewise, we cannot guarantee that the
Service/Application and its content will be permanently accessible, without interruptions. The
User understands and agrees that Naturforma will not be liable in the event that the
Application and/or the Service cannot be accessed, regardless of the reason or duration of
the inability to access them.
Furthermore, we will not be liable for any damage caused by a virus, denial-of-service or
distributed denial-of-service attack, nor for any other type of technological material that may
infect your equipment (computer or mobile terminal), your IT system, your data as a result of
the use of the Service or other websites linked to from our website.
Naturforma does not guarantee that the Service and/or the Application will be secure or
virus-free. The User is responsible for the configuration of their IT systems for access to the
Service/Application and for the use of their own anti-virus software. You must not misuse the
Application by introducing viruses, trojans, worms or other materials that may cause
technological problems. You must not attempt to gain unauthorised access to the Application
or allow access to it by a third party.
Denial-of-service or distributed denial-of-service attacks are not permitted. By breaching this
provision, you would commit an offence under Romanian law, and we will report any such
breach to the competent investigating authorities and will cooperate with the authorities by
providing them with your identity. In the event of such a breach, your right to use the
Application as well as the Service ceases immediately.
The Application is in no way a medical opinion or recommendation, and shall not be
considered a diagnostic or therapeutic tool. The Application does not in any way and for any
reason replace consultation with a specialist physician or specialist nutritionist, who is the
only person competent to establish a diagnosis and provide recommendations appropriate to
the User’s state of health.
A healthy lifestyle implies not only the adoption of an appropriate diet, but also regular
physical exercise and giving up harmful habits (smoking, alcohol consumption), all in balance
with periods of sleep and rest. You agree that your activities relating to the adoption of a diet
and physical exercise involve risks, which may include the risk of bodily injury or death, and
that you assume these risks. You should consult a specialist or your family doctor before
starting or modifying any diet or exercise programme you undertake, and you acknowledge
that you have been informed about the necessity of obtaining such consultations. The
Service may also be used by pregnant women under the guidance of their family doctor.
Naturforma assumes no obligation with respect to (a) the appropriateness of you engaging in
a weight loss programme; (b) the results (or lack of results) obtained through your use of the
Service; and (c) any health-related issues arising in connection with your use of the Service.
Under no circumstances may Naturforma be held liable for any death or bodily injury that you
suffer or cause to any third party, in connection with your use of the Service or with any diet,
exercise or other activity you undertake in connection with the use of the Service.
MODIFICATION OF THE TERMS AND CONDITIONS
Naturforma may revise the terms and conditions of use, as well as any other applicable
terms, at any time by modifying the relevant pages. The terms and conditions may be
subject to any modification, without prior notice, and shall be made known by being
displayed directly in the Application and/or on the websites operated or controlled by
Naturforma SRL. Please check the relevant pages to be aware of any modifications made to
the terms and conditions of use, as such modifications shall apply to you from the time of the
update. If you use the Application/Service after a modification, it is presumed that you have
accepted the modified Terms and Conditions.
Naturforma reserves the right to update the Application at any time and to change its
content. However, please note that the Application may not be up to date at the time of
viewing, and we have no obligation to update it in real time.
Naturforma makes every effort to make available to you all versions of the Terms and
Conditions applicable to you. However, if you cannot identify the version that interests you,
please contact us at any of the contact details on the website, and an operator will provide
you, by e-mail and as soon as possible, with any version of the Terms and Conditions.
COOKIE POLICY
Regarding the use of cookies, please review the Cookie Policy, available here
(https://www.naturforma.com/politica-de-cookie/), which forms an integral part of this
document.
SUPPORT AND ASSISTANCE
NATURFORMA provides Users, during the period of use of the Application/Service, with a
support team.
The support team cannot answer questions/aspects related to services that are not provided
by NATURFORMA SRL beyond the information already existing on the Application, but may
redirect you either to the contact point of the Partners which has the necessary information
and may provide you with such information.
APPLICABLE LAW
Romanian law is applicable to the Agreement as well as to any aspects relating to or in
connection with the content of the Agreement. By accepting the provisions contained in
these Terms and Conditions, you express your agreement that any aspect or dispute arising
from these terms and conditions shall fall under the jurisdiction of the competent courts in
Sfântu Gheorghe, Covasna County, Romania.
